Agreement Terms

Terms may vary by membership level and include different benefits. Guests and authorized users using services purchased by Members accept Agreement Terms by accessing and using travel benefits.

Memberships may include Travel Cash credits, which are promotional instruments redeemable only toward travel services. Travel Cash has no monetary value and carries usage restrictions. Effective March 1, 2026, certain programs may permit members to receive double credits as Travel Cash. Members who fail to opt out within sixty days automatically accept double credits.

By visiting the Website or communicating via email or telephone, users consent to electronic communications, including promotional messages. Definitions

“Buyer” refers to individuals inquiring about purchasing timeshares or renting them for particular stays. “Seller” refers to those offering timeshares for sale or rent. The Company is an “Information Content Provider” under 47 U.S. Code § 230.

“Timeshare” means the right to stay or use real property commonly called hotels or condominiums on a periodic basis, whether through deed, membership agreement, lease, or other contractual arrangement.

No Cooling Off Period

Users acknowledge that the Federal Trade Commission’s 3-day “Cooling-Off Rule” regarding home sales does not apply to transactions conducted through this Website.

Disclaimer – No Warranties

Information contained in this Website is provided “AS IS” without warranties of any kind, either express or implied, including implied warranties of merchantability or fitness for particular purposes. The Company does not warrant that website functions are uninterrupted or error-free, that defects will be corrected, or that the Website is free from viruses or harmful components.

The Company and its affiliates do not guarantee accuracy of materials published on the Website, including pricing, photographs, amenities lists, or product descriptions, which are provided by owners or vendors. No oral or written advice creates any warranty not expressly stated in these Terms of Use.

Users agree that neither the Company, its affiliates, officers, directors, consultants, agents, employees, nor third-party service providers shall be liable for lost profits or any direct, indirect, punitive, incidental, special, or consequential damages arising from Website access or use. Certain state laws may not permit limitations on implied warranties or exclusion of damages.

Your Account

Users are responsible for maintaining account and password confidentiality and restricting computer access. Users accept responsibility for activities occurring under their account or password. The Company reserves rights to refuse service, terminate accounts, remove content, or cancel orders at its discretion.

Electronic Communications

Visiting the Website or sending emails constitutes electronic communication with the Company. Users consent to receive electronic communications including surveys, offers, promotions, and partner products via email or website notices. Users agree that all electronic communications satisfy legal writing requirements. Telephone communications may be recorded.

Electronic Signature

By using the electronic signature feature, users and all entities they represent have chosen to electronically sign agreements. Electronic signatures carry the same legal effect as written signatures. Cancellation Policy

No refunds are issued to consumers after making reservations through the Company.

Pricing

Advertised prices represent rates provided by sellers and are individually authorized by them. Rates may not represent prevailing prices in every area or on every day. Despite efforts, some postings may contain pricing errors. “Rent” and “Rental” describe “Inspection Privilege” services rather than literal denotation.

Risk of Loss

Items purchased from the Website involve transactions between buyers and sellers. Risk of loss and title transfer between these parties.

Product Descriptions

The Company attempts accuracy but does not warrant that product descriptions or Website content are accurate, complete, reliable, current, or error-free. If advertised products are not as described, consumers’ sole remedy is seeking redress directly from sellers.

Published Information by Third Parties

Although the Website includes listings for well-known travel and leisure brands, the Company does not specifically endorse parties offering travel-related products or services. The Company does not assume responsibility or liability for third-party actions, products, or content. Once bookings are made, the Company acts solely as an intermediary between users and vendors.

Reviews, Comments, and Other Content

Users granting content posting rights grant the Company a nonexclusive, royalty-free, perpetual, irrevocable, fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content worldwide in any media. Users represent and warrant ownership or control of posted content rights and indemnify the Company for claims resulting from supplied content.

Applicable Law

Visiting the Website constitutes agreement that Florida law, without conflict of law principles, governs these Terms of Use and related disputes. Users agree that all claims shall be exclusively decided by binding arbitration before an arbitrator selected from the American Arbitration Association. Arbitration is confidential, conducted electronically, and follows AAA Commercial Arbitration Rules. Arbitrator decisions are final and enforceable.

Limitation of Liability & Indemnification

The Company functions as an online marketplace and service provider, not a real estate broker, agent, or rental company. Under no circumstances shall the Company or affiliated companies be liable for damages—direct, special, incidental, consequential, punitive, exemplary, or otherwise—resulting from Website use or inability to use materials, even if advised of possible damages.

Users agree to indemnify and hold the Company, its subsidiaries, affiliates, directors, officers, agents, employees, partners, vendors, and licensors harmless from claims or demands—including reasonable attorney fees—arising from information users submit through the Website; Website use or Company services; breach of warranties or Terms provisions; or violations of other users’ rights.

Rights and Licenses in the Website

The Company grants users a limited, personal, nontransferable, non-sublicensable, revocable license to access and use the Website only as expressly permitted in these Terms of Use. Buyers

Searchable Marketplace

The Company provides a searchable marketplace for researching and identifying seller-offered timeshares. Users agree not to take travel-related action until confirming ownership or right to use. Sellers bear responsibility for such confirmation and users hold the Company harmless for losses resulting from inability to use advertised timeshares.

Disclaimers

The Company does not recommend, endorse, or guarantee any timeshare presented on the Website. The Company assumes no responsibility and is not liable for advertised timeshare conditions or description accuracy—descriptions are seller-submitted advertisements presented “as is.”

Travel Interruptions and Risks

Although most travel proceeds without serious incidents, some destinations involve greater risks. The Company urges travelers to research visited locations and review travel prohibitions, warnings, announcements, and advisories from United States Government agencies including the State Department, TSA, DOT, FAA, CDC, Treasury Department, and Customs Service.

To the maximum extent permitted by law, the Company and its affiliates accept no responsibility for damage or delay from owner cancellations, quarantine, government restraints, weather, terrorism, or uncontrollable causes. The Company is not responsible for owners’ warranty breaches or agreement breaches nor for failure to comply with applicable law.

Contact Information

Users agree that the Company may provide seller and/or assigned agents with provided contact information to facilitate transaction discussion, term negotiation, contract execution, and related activities. Users acknowledge that the Company is not responsible for qualifying potential buyers or assisting transactions.

All Sellers – General Terms

To protect users, sellers receive agreements outlining rights and obligations prior to transaction entry. All sellers must acknowledge reviewing and agreeing to Terms of Use and written Agreement terms to subscribe or receive services.

Seller Eligibility & Representations

Services are available only to sellers capable of forming legally binding contracts under applicable law. Sellers represent that all submitted information during Website registration is true and correct and agree to promptly notify the Website of contact information updates.

Sellers further represent and covenant that they own and possess necessary rights and authority to offer, use, or sell advertised properties; will honor Terms of Use and associated agreement terms; will accurately describe properties and disclose material defects; and will provide refunds when due under Terms or underlying agreements.

Terms of Advertising

The Company reserves rights, at discretion, to refuse, deny, or cancel advertisements. Advertised property maintenance fees must be paid in full. Sellers must not deposit or commit properties to third parties. The Company accepts seller properties no less than three weeks prior to property check-in dates.

Confidentiality

Except as expressly provided, neither sellers nor Company affiliates shall disclose agreement terms or conditions beyond their existence and duration. Parties may disclose Confidential Information when required by court, administrative agency, or governmental body orders, provided parties use commercially reasonable efforts to provide prompt disclosure notice.

Subscription Term, Refunds & Termination

Generally, refunds are unavailable unless sellers qualify under guarantee programs. If sellers purchase subscriptions but do not complete advertisement creation, refund requests are considered only within the first three days following purchase. Agreements may be immediately terminated without notice for material default, insolvency proceedings, general assignment for creditors, or dissolution.

Limitations on Communication

Users agree to use other users’ personal information obtained through the Website only for Website-related communications and inquiries. The Company does not tolerate spam or unsolicited commercial electronic communications. Users may not add Website users to mailing lists without express consent.

Florida Disclosures

Pursuant to Florida Statute §721.205, upon timeshare sales, additional costs to third parties may be due including resort transfer fees, title fees and costs, government recording fees, and taxes. Timeshare owners remain obligated for all fees and costs payable to owner associations, finance companies, or other contracted providers. The Company recommends users utilize licensed title agencies administering timeshare closings to avoid fraud or excessive third-party demands.

Unauthorized Payment Methods

The Company is not party to buyer-seller payment transactions. Sellers may not request buyers mail cash or use instant-cash wire transfer services such as PayPal, Western Union, or MoneyGram. Violations may result in immediate non-conforming advertisement removal without seller notice or refund.

Intellectual Property

Copyright

All Website-included content—such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software—is Company or content owner property, protected by United States and international copyright laws. All Website content compilation is exclusive Company property.

Trademarks

Company identifiers on the Website—including graphics, logos, page headers, button icons, scripts, and service names—are Company trademarks, registered trademarks, or trade dress in the U.S. and/or other countries. Company trademarks and trade dress may not be used with non-Company products or services likely causing customer confusion.

License and Website Access

The Company grants limited access and personal use licenses for the Website without downloading or modifying it, except with express Company written consent. Licenses do not include resale or commercial Website use, product listing or price collection and use, or data mining, robots, or similar data gathering and extraction tools.

Notice and Procedure for Copyright Infringement Claims

If users believe their works have been copied constituting copyright infringement, they should provide the Company’s copyright agent with: (1) an electronic or physical signature of the person authorized to act on the copyright owner’s behalf; (2) a description of the copyrighted work claimed as infringed; (3) a description of the infringing material’s location on the Website; (4) the claimant’s contact information; and (5) statements by the claimant, under penalty of perjury, that the disputed use is not authorized and that the information provided is accurate.

The Company occasionally sends advertisements, marketing material, or other offers on other businesses’ behalf. The Company will not share texting/SMS telephone numbers or related opt-in information with third-party businesses.

Credit Card and Bank Check Processing
